These Terms of Use govern your access to and use of the website operated by Albert Yang Facial Plastic Surgery (the "Practice"), with offices at 15600 NE 8th St, Suite A-8, Bellevue, WA 98008. Please read these Terms carefully before using the website.
1. Acceptance of Terms
By accessing or using this website (the "Site"), you agree to be bound by these Terms of Use ("Terms") and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not access or use the Site. Your continued use of the Site following the posting of any changes to these Terms constitutes acceptance of those changes.
2. Medical Disclaimer
The content available on this Site — including all text, images, graphics, before-and-after photographs, procedure descriptions, articles, and other materials — is provided for general educational and informational purposes only. It is not medical advice, is not a substitute for professional medical evaluation, diagnosis, or treatment, and should not be relied upon for any individual medical decision.
Facial plastic surgery is a serious medical undertaking. Surgical candidacy, technique selection, expected results, recovery, and potential risks are determined on a case-by-case basis and require a qualified surgeon's in-person evaluation of your medical history, anatomy, and goals. Outcomes shown in any photograph or described in any educational text on the Site reflect individual cases under specific clinical conditions and do not constitute a representation, warranty, or prediction of outcome for any other patient. Individual results vary.
If you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on the Site, electronic communication, or any contact form for urgent medical needs.
3. No Doctor-Patient Relationship
Use of the Site does not create a physician-patient relationship between you and Albert Yang, MD or any clinician affiliated with the Practice. Submitting an inquiry through a contact form, signing up for a newsletter, requesting information, or otherwise communicating through the Site does not establish any treatment relationship.
A physician-patient relationship is established only after (a) you have completed an in-person consultation with Albert Yang, MD or another credentialed clinician of the Practice; (b) the Practice has accepted you for evaluation or care; and (c) any required intake forms, consents, and payment arrangements have been executed. Until those steps are complete, no medical advice is being rendered through the Site.
4. Intellectual Property
All content on the Site — including text, photographs, before-and-after images, procedure descriptions, logos, trade names, design elements, code, and educational articles — is the property of the Practice or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. "Albert Yang Facial Plastic Surgery" and the Practice's logos are trademarks of the Practice.
You may view, download for caching purposes only, and print pages of the Site for your own personal, non-commercial reference, provided you do not modify the content and you preserve all copyright and other proprietary notices. Any other use — including reproduction, redistribution, modification, public display, public performance, or creation of derivative works — requires the prior written permission of the Practice. Unauthorized use may result in civil and criminal penalties.
Patient before-and-after photographs are published only with the depicted patient's signed, informed consent and remain the property of the Practice. They may not be downloaded, copied, redistributed, or used for any other purpose without express written permission.
5. Acceptable Use
You agree not to use the Site:
- In any manner that violates applicable federal, state, local, or international law or regulation;
- To impersonate or attempt to impersonate the Practice, an employee, another user, or any other person or entity;
- To engage in any conduct that restricts or inhibits anyone else's use of the Site, or which the Practice determines may harm the Practice, the users of the Site, or expose them to liability;
- To upload or transmit any virus, worm, malware, or other malicious code, or to otherwise interfere with the proper functioning of the Site;
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Site, the servers on which the Site is hosted, or any server, computer, or database connected to the Site;
- To collect or harvest information about other users without their consent;
- To submit medical information about another individual without their authorization.
The Practice reserves the right, in its sole discretion, to terminate your access to all or any part of the Site at any time, without notice, for any reason, including violation of these Terms.
6. Submissions and Communications
Any non-confidential information you submit through general Site forms or general email channels (other than protected health information submitted under appropriate HIPAA-compliant intake processes) is submitted on a non-confidential basis. The Practice may use such submissions for any lawful purpose, including evaluating Site improvements, without obligation of compensation.
Do not submit protected health information ("PHI") through unsecured contact forms, general email, or social-media direct messages. PHI should be submitted only through HIPAA-compliant intake channels established by the Practice during the patient-onboarding process. The Practice's handling of PHI is governed by federal and state privacy laws and by the Privacy Policy.
7. Third-Party Links and Content
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by the Practice. The Practice provides these links for convenience and reference only. The inclusion of a link does not imply endorsement of the third-party site or any association with its operators.
The Practice has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party website. You acknowledge and agree that the Practice is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance on, any such content, goods, or services available on or through any third-party website.
8. Disclaimer of Warranties
The Site and all content on it are provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, the Practice disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency, or uninterrupted availability.
The Practice does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, nor that any defects will be corrected. You assume the entire risk associated with your use of the Site.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will the Practice, its owners, members, officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation loss of profits, loss of data, loss of goodwill, business interruption, personal injury, or pain and suffering — arising out of or in connection with your access to, use of, or inability to use the Site, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not the Practice has been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the Practice's liability shall be limited to the maximum extent permitted by law. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including liability for fraud or for personal injury caused by negligence).
10. Indemnification
You agree to defend, indemnify, and hold harmless the Practice and its owners, members, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
11. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them or your use of the Site are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction and venue in those courts.
12. Changes to These Terms
The Practice may revise these Terms at any time, in its sole discretion, by posting an updated version on this page and updating the "Last updated" date. Material changes will be highlighted where reasonable. It is your responsibility to review these Terms periodically. Your continued use of the Site after any change constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
14. Entire Agreement
These Terms, together with the Privacy Policy and any other notices posted on the Site, constitute the entire agreement between you and the Practice regarding the Site, superseding any prior agreements or understandings.
